Liquid‐liquid phase separation (LLPS) has recently emerged as a possible mechanism that enables ubiquitin‐binding shuttle proteins to facilitate the degradation of ubiquitinated substrates via distinct protein quality control (PQC) pathways. Shuttle protein LLPS is modulated by multivalent interactions among their various domains as well as heterotypic interactions with polyubiquitin chains. Here, the properties of three different shuttle proteins (hHR23B, p62, and UBQLN2) are closely examined, unifying principles for the molecular determinants of their LLPS are identified, and how LLPS is connected (...) to their functions is discussed. Evidence supporting LLPS of other shuttle proteins is also found. In this review, it is proposed that shuttle protein LLPS leads to spatiotemporal regulation of PQC activities by mediating the recruitment of PQC machinery (including proteasomes or autophagic components) to biomolecular condensates, assembly/disassembly of condensates, selective enrichment of client proteins, and extraction of ubiquitinated proteins from condensates in cells. Vietnam is home to a prospering technology community and numerous enterprises that range from small start-ups to development giants. Virtually all public services are offered online. In fact, the country even has a system for e-residency and “data embassies.” This achievement derives in part from the nation’s transparent and enduring political preferences, but more importantly from Vietnamese law and its regulatory system regarding information, the digital general public, and intellectual property rights (IPR) protection. In this examination of the most pertinent (...) aspects of Vietnam’s digital economy legislation, this study explores the nation’s regulatory structure regarding copyright and patents within the context of digital transformation. The study discusses the relationship between foreign and national regulations in terms of IPR protection and the advancement of digitalization. Research on Vietnamese regulations and the practical application of major patent and copyright regulations has revealed that in many respects, the nation is highly reliant on the effective operation of a broader foreign institutional and legal framework. Thus, in the near future, technological advancement will necessitate the establishment of additional transnational regulatory systems. (shrink)

Antimicrobial resistance (AMR) is a global public health disaster driven largely by antibiotic use in human health care. Doctors considering whether to prescribe antibiotics face an ethical conflict between upholding individual patient health and advancing public health aims. Existing literature mainly examines whether patients awaiting consultations desire or expect to receive antibiotic prescriptions, but does not report views of the wider public regarding conditions under which doctors should prescribe antibiotics. It also does not explore the ethical significance of public views (...) or their sensitivity to awareness of AMR risks or the standpoint (self-interested or impartial) taken by participants. Methods: An online survey was conducted with a sample of the U.S. public (n = 158). Participants were asked to indicate what relative priority should be given to individual patients and society-at-large from various standpoints and in various contexts, including antibiotic prescription. Results: Of the participants, 50.3% thought that doctors should generally prioritize individual patients over society, whereas 32.0% prioritized society over individual patients. When asked in the context of AMR, 39.2% prioritized individuals whereas 45.5% prioritized society. Participants were significantly less willing to prioritize society over individuals when they themselves were the patient, both in general (p = .001) and in relation to AMR specifically (p = .006). Conclusions: Participants’ attitudes were more oriented to society and sensitive to collective responsibility when informed about the social costs of antibiotic use and when considered from a third-person rather than first-person perspective. That is, as participants came closer to taking the perspective of an informed and impartial “ideal observer,” their support for prioritizing society increased. Our findings suggest that, insofar as antibiotic policies and practices should be informed by attitudes that are impartial and well-informed, there is significant support for prioritizing society. Thus was the case of Warring States China, which saw the rise of the Hundred Schools of Thought, including the Doadejing and the Han Feizi, and Renaissance Italy, which produced Niccolò Machiavelli. Witnessing their respective societies fall prey to internal corruption and external aggression, all three thinkers sought ways to produce a strong, stable state that would allow both the leader and the populace to endure. Fortune and the (...) Dao: A Comparative Study of Machiavelli, the Daodejing, and the Han Feizi demonstrates where the shortcomings of each theory lie, with emphasis on the similarities among Machiavelli, Laozi, and Han Feizi. Jason P. Blahuta ultimately argues that if Machiavelli’s philosophy, the most comprehensive of the three theories, were supplemented by aspects of the Daodejing, the revision would potentially overcome the deficiencies of the original. BackgroundECMO is a particularly scarce resource during the COVID-19 pandemic. Its allocation involves ethical considerations that may be different to usual times. There is limited pre-pandemic literature on the ethical factors that ECMO physicians consider during ECMO allocation. During the pandemic, there has been relatively little professional guidance specifically relating to ethics and ECMO allocation; although there has been active ethical debate about allocation of other critical care resources. We report the results of a small international exploratory survey of ECMO (...) clinicians’ views on different patient factors in ECMO decision-making prior to and during the COVID-19 pandemic. We then outline current ethical decision procedures and recommendations for rationing life-sustaining treatment during the COVID-19 pandemic, and examine the extent to which current guidelines for ECMO allocation (and reported practice) adhere to these ethical guidelines and recommendations.MethodsAn online survey was performed with responses recorded between mid May and mid August 2020. Participants (n = 48) were sourced from the ECMOCard study group—an international group of experts (n = 120) taking part in a prospective international study of ECMO and intensive care for patients during the COVID-19 pandemic. The survey compared the extent to which certain ethical factors involved in ECMO resource allocation were considered prior to and during the pandemic.ResultsWhen initiating ECMO during the pandemic, compared to usual times, participants reported giving more ethical weight to the benefit of ECMO to other patients not yet admitted as opposed to those already receiving ECMO, (p < 0.001). If a full unit were referred a good candidate for ECMO, participants were more likely during the pandemic to consider discontinuing ECMO from a current patient with low chance of survival (53% during pandemic vs. 33% prior p = 0.002). If the clinical team recommends that ECMO should cease, but family do not agree, the majority of participants indicated that they would continue treatment, both in usual circumstances (67%) and during the pandemic (56%).ConclusionsWe found differences during the COVID-19 pandemic in prioritisation of several ethical factors in the context of ECMO allocation. The ethical principles prioritised by survey participants were largely consistent with ECMO allocation guidelines, current ethical decision procedures and recommendations for allocation of life-sustaining treatment during the COVID-19 pandemic. Philosophers in China during the Warring States period generally saw themselves as investigators into the Dao—the uniquely authoritative Way to live and to flourish. Certain voices found in the Zhuangzi, however, offer a radical response to this project by rejecting the premise that there exists such a uniquely authoritative Dao. Instead, they argue that there exist myriad, diverse dao, none of which has absolute moral authority. Yet the very texts that undermine the idea of an authoritative Dao simultaneously make positive (...) ethical suggestions regarding how to live and flourish. In this paper I explore texts in the Zhuangzi that discuss the diversity of dao and sagely flourishing, and I argue that these two themes come together to form the basis of a comprehensive ethical view that I call Zhuangist pluralism. The 1973 archeological discovery of important documents of classical thought known as the Huang-Lao Boshu coupled with advancements in contemporary jurisprudence make possible a reassessment of the philosophies of pre-Qin and early Han China. This study attempts to elucidate the importance of the Huang-Lao school within the intellectual tradition of China through a comparison of the Boshu's philosophical position, particularly its understanding of the relation between law and morality, with the respective views of major thinkers of the period--Confucius, Han Fei, (...) Lao Zi, Zhuang Zi, and to a lesser extent, Shen Dao, Shen Buhai and the authors of the Guan Zi and He Guan Zi. So doing reveals Huang-Lao to be a unique and sophisticated social and political philosophy which, until its expulsion from court by Emperor Wu and subsequent adoption by Daoist religion, served as the ideological foundation for the post-Qin reforms of the early Han. Han Feizi’s 韓非子 thought, I argue, contains a political theory that justifies principled, law-governed government. A key element of his theory is a solution to the problem of rectifying names. He recognized that the same word can have varying criteria of application depending on the purpose of the practice that requires a criterion. Some criteria for a practice are good and some bad. A wise ruler knows which criteria are good and appropriate to ruling. It’s a pleasure to read again Eric S. Nelson’s scholarly prose with its own specific conceptual style and distinctive philosophical rhythm. It’s a challenge to give a meaningful and fair overview of a conceptually complex, scholarly rich, and thought-provoking book.No one can speak better about the aim and goals of Nelson’s book than the author himself--following the wayist way of spontaneous ziranity, we will thus let the book speak for itself:Its primary thesis is that, entangled with Daoist and other intercultural sources, Heidegger’s path proceeds from the paradigmatic Occidental philosophy of available givenness and mere presence--which conceals the open spacing of things and seeks to logically exclude and dialectically subordinate negativity and the nothing--to nothingness, emptiness, and the clearing in their coming to presence and withdrawal in absence or, to accentuate its mutable verbal sense, presencing-absencing. […] Zhuangzi’s vision of free and easy wandering indicates ways of practicing philosophy as contesting and unraveling fixations. This is certainly true (...) for Laozi studies in America since two new translations of the Daodejing offer contrasting yet complementary readings of this ancient Daoist canon: Moss Roberts' Daodejing: The Book of the Way, and Philip J. Ivanoe's The Daodejing of Laozi. The Daodejing is the most translated of the Chinese classics, and there are more than "forty versions in English alone" (Roberts, p. 9). What makes these two new translations stand out is the linguistic sensitivity and philosophical sophistication of both.Ludwig Wittgenstein once compared the complexity and multiplicity of language to a confusing "ancient city" with "a maze of little streets and squares, of old and new houses, and of houses with additions from various periods."1 Likewise, translating an ancient text into a modern language resembles leading readers through a labyrinth of strange city streets. The Daodejing is such a challenging text. Its mystical subject matter, its brevity, and the lexical and grammatical changes in the Chinese language all make it especially demanding for translators. According to Jacques Lacan, there is "an incessant sliding of the signified under the signifier."2 The linguistic sliding from classical Chinese to modern English is as enormous as a continental shift. The connotations of many words have changed so much that it is often very difficult to determine the most appropriate choice for some seemingly simple words. For example, in the opening stanza the word miao 妙 would appear easy to translate. In modern Chinese, miao means "wonder," "excellence," or "subtlety." However, according to the commentary of the third-century philosopher Wang Bi, miao refers to "the infinitesimal, for the ten thousand things initiate from the infinitesimal." 3 It becomes a crucial yet complicated task for a translator to determine which word one is willing to use in order to convey the meaning of the original text.4The grammatical structure of the Daodejing poses another serious challenge to translators. In classical Chinese, the subject of a sentence is often omitted and a noun can be used as a verb, depending on the context. It is very confusing for non Chinese readers if the text is translated word for word, as some translators have attempted to do. An effective translation must preserve intended meanings and at the same time present them comprehensibly to the reader. Considering the linguistic challenge in the translation of the text, it is amazing to see how both Roberts and [End Page 487] Ivanhoe have offered us two equally accurate yet stylistically contrasting readings of the same work. Because of his training in classical Chinese literature, Roberts is better able to preserve the stylistic characteristics of the original text. The translation by philosopher Ivanhoe focuses on precision and clarity of terminology. Reading both their versions of the Daodejing is like listening to two masters performing the same musical piece: it is not the melody but their expression and interpretations that increase our appreciation and understanding.5Roberts' Daodejing: The Book of the Way is an outstanding translation because he has so skillfully employed the English language to convey successfully the poetic quality of the Daodejing, a quality that, in my opinion, has often been overlooked by many previous translators. As Roberts states in his Introduction, his version attempts to "reproduce the condensed aphoristic force of Laozi's style, the appeal of his intriguing and often indeterminate syntax, and the prevalence of rhymed verse in his original" (p. 3). The Daodejing is a hybrid text combining both verse and prose.6 The versed sections often state philosophical principles or tenets, while the prose sections offer definitions or arguments.7 By faithfully following the structure of the original work, Roberts has contributed greatly to the study of the Daodejing by providing non-Chinese readers an opportunity to experience the beauty of form... Pp. 134, Paperback $29.95, ISBN 978-1-4875-4095-1.John Miller’s Taoism, Teaching, and Learning: A Nature-Based Approach to Education (hereafter Taoism, Teaching, and Learning) develops a (...) nature-based account of modern education grounded in Daoism (or Taoism), a school of thought often misunderstood in the West. Daoism has historically been categorized both as a religion (dao jiao 道教) and as a philosophy (dao jia zhe xue 道家哲學); in many cases the spiritual and mystical side of Daoism impresses itself on the reader at the expense of its scientific and philosophical side--as happened with the European missionaries who first exported Daoism to the West. Yet Daoism, especially in relation to pedagogy, cuts across this philosophical/mystical distinction. Happily, Miller and his students, Xiang Li and Tian Ruan, betray no such tendency to pigeon-hole Daoism into one or the other of these categories. The authors adopt a connected and holistic concept of Daoism, which they use to inform and justify their approach to modern education. As such, in the eight chapters of this book, we can see a natural and sensible connection between a holistic Daoism--spiritual, mystical and philosophical--and modern philosophical and educational theories, including Montessori’s cosmic education, Steiner Education, holistic education, and the pedagogical practices of meditation and mindfulness.Miller’s modus operandi is to apply Daoist concepts to contemporary (especially Western) educational issues, both theoretically and practically. In terms of the Daoist belief in the interconnectedness of all things, Miller questions modern subject divisions. When we divide education into geometry, mathematics and so on, we fragment the natural oneness of knowledge and reality as the Daoists would have it. Instead, Miller advocates faith in nature and looks to curricula that reflect the wholeness of nature, such as “cosmic education” and “holistic education” (Chapters 2 and 6). Through such education “we see the relationship between the physical, intellectual, emotional, and spiritual dimensions of life” (p. 27), and feel the support from the invisible and unproven world.Miller makes excellent use of the Daoist concepts of yin (陰) and yang [End Page 1] (陽), which signify the complementary balance and interplay between opposites. He uses the yinyang paradigm to explore the need for balance in a wide range of interesting and important pedagogical situations; for instance, group collaboration versus individual competition, knowledge versus imagination, intuition versus reason, qualitative versus quantitative, etc. (Chapter 5). He also implements yinyang to unpack the model of creative thinking laid down by Graham Wallace (pp. 66 -70); here, yin and yang are applied to a process within the individual. As we move from confusion to enlightenment, we enact within ourselves a dance between our yin and yang factors.Under the heading “Self-Cultivation” (Chapter 3), Miller attempts to evaluate a number of pedagogical strategies with broad ties to Daoism; namely, “silence,” “contemplation,” “calmness,” “sincerity,” “non-violence and embracing the feminine,” and “humility”. These are informed by Miller’s own personal experience of teaching and applying meditation at the University of Toronto. This provides a useful connection between the spiritual and philosophical dao 道, the mystical and the practical. Em um primeiro momento, faço uma breve avaliação qualitativa da produção acadêmica sobre o pentecostalismo no Brasil. Em seguida, reflito sobre o processo de conversão ao pentecostalismo nos quilombos do Vale do Ribeira, São Paulo. A conversão em comunidades tradicionais, como as de caiçaras e quilombolas, tem se mantido como uma lacuna nas pesquisas dos estudiosos. No mínimo, as circunstâncias e os contextos em que se dão essas conversões não têm sido levados em consideração. Aponto aqui as relações entre formas (...) tradicionais e modernas de organização social como um dos fatores importantes para se entender a razão do forte apelo que o pentecostalismo exerce sobre as comunidades tradicionais. A capacidade que as igrejas pentecostais têm de fazer uma interface amigável no processo de transição para a modernidade e, ao mesmo tempo, de garantir a permanência de elementos tradicionais importantes para a manutenção de estruturas sociais necessárias à sobrevivência do grupo dá ao pentecostalismo a vantagem competitiva que lhe confere papel de destaque nas comunidades estudadas. Palavras-chave : Pentecostalismo; Conversão; Comunidades Tradicionais; Modernidade; Vale do Ribeira.This article makes a brief qualitative evaluation of the academic production on Pentecostalism in Brazil and also reflects on the process of convertion to Pentecostalism in the quilombos communities on the Vale do Ribeira in São Paulo. Research scholars have left out the conversions in traditional communities such as the caiçaras and the quilombolas. The circumstances and contexts in which these conversions take place have not been taken into consideration. This articles also presents the relationship between traditional and modern forms of social organization as an important factor to understand the reason for the strong appeal of Pentecostalism on traditional communities. The ability that Pentecostal churches have to make a friendly interface in the transition process to modernity and, at the same time, to ensure the continuation of those traditional and relevant elements for the maintenance of social structures necessary for the survival of the group, gives to Pentecostalism the competitive advantage which guarantees to the Pentecostal Groups a prominent role in the communities studied. The aesthetic spirit in Paik Nam June’s video art, TV Buddha, originated in the aesthetics of Zen Buddhism, and the parameters that established Paik’s aesthetic comprised the indigenous Eastern aesthetic idea of dongjing 動靜. Yi 逸 is the paramount aesthetic in Zen Buddhism, suggesting the transcendence of preexisting tracks and conventions. Paik’s behavioral music, to which he was dedicated before pioneering video art in earnest, was related to yi in terms of the complete aspects of forms, themes, and so on, (...) evidently under the influence of avant-garde musical composer John Cage. The Zen Buddhist aesthetic—and Paik’s artistic motto—is to capture the essence of the self and the world through the destruction of stereotypes. Paik’s artistic uniqueness lies in his attempts to combine his traditional culture and spirit—the culture and ideas of Korea and Eastern Asia—with cutting-edge technology. The hallmark of Paik’s video art can be understood as a suggestion of philosophical subjects guided by the interrelation between a graphical presentation on a TV screen and the whole installation setup. The philosophical subject in TV Buddha is Zen Buddhist meditation symbolized in the structure of dongjing. (shrink)

Under the clear and thoughtful editorship of Ruiping Fan, The Renaissance of Confucianism in Contemporary China provides new and highly substantive insights into the emergence of a renewed, relevant, and perceptively engaged Confucianism in 21st century China. Through the vibrantly diverse essays contained in this volume, and in cogent overview through Fan’s introduction, one learns that Confucianism is thoroughly misunderstood, if it is seen only through Western lenses. It cannot be absorbed into that rights-based “global” discourse that has been the (...) West’s troubled inheritance from the Enlightenment. Extraordinarily thoughtful Chinese voices are found in this volume that converse with each other in serious and revealing ways. In several previous publications, Yuan has addressed the word-meaning controversy from different angles and in various classics, including Prajnaparamita and The Analects.The word-meaning debate, as Yuan explains, can be interpreted as a conflict between cognition and expression, and reveals a series of contradictions and conflicts in ontology, epistemology, and philosophy of life among scholars in the Wei-Jin period. The debate refers to the controversy on whether words can fully express meaning or not. It departs from the relationships between word and meaning to critically evaluate their functions and limitations, and mainly consists of two ways of thinking: "distinguishing names, analyzing principles" (bian ming xi li 辯名析理) and "getting the meaning, forgetting the words" (de yi wang yan 得意忘言). Although this debate had already developed in China for quite some time, it was only prevalent as a common philosophical theme in the Wei-Jin period, a time characterized by social disorder and endless war. The metaphor in the book title, "a leaky boat holding wine," is from one of Lu Xun's (1881) poems, illustrating that although people use words as a tool to express meaning, it is impossible for words to convey all meaning. Yuan uses the metaphor to refer to the capacity of a word to carry meaning, and indicates that human thought and expression are inseparable from words, but cannot be entirely restricted to them.The book is organized in chronological order, and readers can easily grasp how the word-meaning debate was developed and reshaped in different periods, responding to various social-political contexts. Chapter 1 starts with the origin of the debate in the early Qin period. The author provides a solid examination of relevant theories and high-quality secondary literature. She clearly demonstrates that both early Daoist and Confucian thinkers were involved in the debate, and [End Page 1] that it aimed to describe a core ontology--or a search for the principles of the cosmos--and understand various other aspects of the world, including natural cycles and social ethics. Confucius advocated a metaphorical grasp of the Dao, transforming epistemology into practical philosophy. He held a critical attitude toward the relationship of word and meaning, arguing that words could express meaning because people could use them to influence the state and society. Confucius also believed that Dao, as an imaginative and contextual concept, could not be expressed through words.In contrast, Zhuangzi--"the most significant source of inspiration for Neo-Daoism (Metaphysics) in the Wei-Jin period" (p. 70)--focuses on the limitations of the function of words to convey meaning, highlighting the ineffable nature of Dao. Zhuangzi's concept of Dao, according to Yuan, is always beyond the reach of our senses and can only be attained through an intuitive grasp of reality: through the ability to reach an epiphany and perceive through the mind, even when not observing through physical means. It is only with an intuitive way of thinking that one can identify the ultimate noumenon and grasp the idea of Dao when words cannot contain it. Integrated information theory (IIT) is a candidate theory of consciousness that highlights the role of complex interactions between parts of a system as the basis of consciousness – and, due to its general information-theoretic formulation, is capable of making statements about consciousness in neural and non-neural systems alike. Here, we argue that a system radically different to a human brain, host to complex physiological and functional structures capable of integrating information, can be found in the meristems and vascular system of (...) higher plants. Following a pragmatic and ontologically innocent approach, neither taking for granted that plants are conscious nor dismissing the possibility that they are, we argue that the time is ripe to apply analysis tools inspired by IIT to plants, taking advantage of recent developments in both plant imaging and information theory. We introduce and discuss the relevant literature, and pro information and integration in plant behaviour, assessing the plausibility of plant sentience. If successful, these experiments could position plants as the next frontier in consciousness science, and urge us to rethink our perspectives on consciousness, how to measure it, and its prevalence amongst living beings. Pound's answer is explicit and categorical: "I believe the Ta Hio" (Da Xue). Confucianism, Pound believes, offers a solution to the West that, from its political institutions to its economic system, has fallen into chaos and disorder. Ideology and aesthetics are inextricable. Pound also sees in Confucianism a way of making poetry in articulating his vision (...) of a new earthly paradise. In The Cantos, Pound covers numerous people and cultures across times and space, and Thomas Jefferson and John Adams stand out as two of Pound's preeminent Confucian heroes. Pound's view of Jefferson and Adams, of course, involves his views on politics, economics, law, and history—a host of complicated issues that cannot be all accounted for by his reading of Confucianism. Similarly, Pound's poetics is also influenced by various traditions.1 This study, however, focuses on the extent to which Pound's Confucianism has contributed to his reading of Jefferson and Adams and to his poetics. It specifically examines the relationship between Pound's Confucianism and his poetic form in presenting Jefferson and Adams—that is, how the poet brings his Confucianism to making heroes out of history, and how his poetic form serves to express his Confucian world-view.ISeveral aspects about Pound's Confucianism need to be addressed briefly, for they are essential to his evaluation of people and to his Confucian poetics. First of all, Pound considers Confucianism a totalizing philosophy rooted in the objective reality of organic nature.2 He believes that the Confucian Dao,which he refers to as the "process," not [End Page 57] only operates as an inherent unifying principle of harmonious order manifest in nature but also sets the norm to be followed in establishing culture.3 Unlike other failing metaphysical religions, Confucianism, in Pound's view, does not commit "splitting"—the separation of ideas from the phenomenal or culture from nature. Greek philosophy, he thinks, commits "splitting," for the Greek philosophers "have been served up as highbrows. We know them as ideas, each handed us as a maxim."4 He believes "Christian thought has never offered a balanced system"(GK, p. 29). The Eleusinian elements might be present in the very early church, but the ancient wisdom "seems to have disappeared when the mysteries entered the vain space of Christian theological discussion."5 In contrast, Confucianism, he believes, is totalizing in the sense that "Confucius offers a way of life, an Anschauung or disposition toward nature and man and a system for dealing with both" (GK, p. 24). Because of Confucianism, he maintains, "I fail to see that the history of China, or Chinese historic process, suffers a dichotomy or split into two opposite forces, as does that of Europe" (Prose, p. 67).Pound considers Confucianism not just a balanced system; he finds Confucianism particularly attractive because of Confucius's deep concern with man and culture, his focus on social and ethical issues, his emphasis on individual responsibility, and, above all, his strong commitment to realizing social order and harmony in this world. Greek philosophy, Pound feels, ignores the question of individual responsibility and the feeling of common people, and the Greek philosophers "did not feel communal responsibilities vide infra. The sense of coordination, of the individual in a milieu is not in them" (GK, p. 38). He thinks that Greek philosophic thought "is at no point impregnated with a feeling for the whole people" (GK, p. 29). Pp. 1,020.Encyclopedias can be useful in teaching philosophy when students need some reading that sets out the basics on a key topic in a few pages without their getting lost in too many complex details or being misled by oversimplifications. They can also be edifying for the philosophy teacher and (...) scholar—providing reliable, up-to-date information on topics that lie in their field but that are not part of their working knowledge. For these reasons, those working in Chinese philosophy will welcome the publication of the Encyclopedia of Chinese Philosophy. The 187 entries cover a variety of subject areas such as "Moral Philosophy" and "Philosophy of language"; Confucianism in different periods and countries, Daoism, Mohism, Legalism, the school of names, Buddhism, and Marxism in China; philosophical trends in post-Mao China, Taiwan, and overseas; key concepts such as dao (the way), fa (law, standards), liyi fenshu (principle and manifestations), and quanli (rights); texts such as the Huainanzi and the Wenzi; and thinkers from Laozi and Confucius to Hu Shih and Mou Zongsan.Instead of more numerous short entries, this encyclopedia has opted for fewer entries of greater length—the Preface tells us that entries on important thinkers and philosophical topics typically range from five thousand to nine thousand words in length, and a quick check reveals that even the shortest entry is at least two pages long (more than one thousand words). This format allows authors to explore the philosophical issues at some depth, and expound even complex arguments in detail. The connections between different concepts, thinkers, texts, philosophical theories, and development that stretch across different periods and territories can be delineated more clearly in a single entry. There is a danger of duplication with this format, as some texts and concepts may be covered in several articles; for example, most of "Confucianism: Constructs of Classical Thought" is on what the author identifies as six key texts of Classical Confucianism: the Analects, Mencius, Xunzi, Yizhuan, Zhongyong (Doctrine of the mean), and Daxue (Great Learning). The sections on Mencius and Xunzi (pp. 66-67) merely introduce a small part of what is discussed in much greater depth and detail in the entries on these two thinkers (pp. 440-448 and 821-829). The Zhongyong and Daxue also have their own entries, and "Confucianism: Confucius" (p. 61) contains an entire section on the Analects.As it turns out, the duplication is less than expected. Pei-jung Fu, author of "Confucianism: Constructs of Classical Thought," implicitly questions Xunzi's Confucian pedigree, beginning his discussion with "Xunzi professed to be an advocate of Confucianism" (p. 67). Such doubt is clearly not shared by A. S. Cua, who authored [End Page 111] the entry on "Xunzi," introducing the thinker as "an important exponent of classical Confucianism" (p. 821). Cua also does not share Fu's view that "the real issue between Mencius and Xunzi lies in their concepts of heaven (tian)" (p. 67). Fu and the author of the entry on the Zhongyong translate key terms in the texts differently: Fu discusses "five ethical codes" and "three comprehensive virtues" (p. 68) while Yanming An calls them "five universal paths" and "three universal virtues" (p. 890). Such differences can be either thought provoking or confusing (especially when unaccompanied by Chinese characters or even pinyin), depending on the reader. The sections on the Analects in "Confucianism: Confucius" and "Confucianism: Constructs of Classical Thought" have hardly anything in common; the first examines it as an account of how Confucius lives as an exemplar remembered by his students, while the latter discusses its content, focusing on ren and li, as well as on Confucius' religious concerns. While concepts such as ren and li are frequently discussed, the different ways in which authors employ them and the different characteristics, contexts, and philosophical stakes they pay attention to enrich one's understanding of the many dimensions of these concepts even as similarities in diverse entries reinforce certain aspects and perspectives.One comes across disagreements to various degrees on common or related topics among different entries. Accidental infringement of copyright is a pervasive and largely ignored problem. In the twenty-first century, it has become increasingly easy to infringe copyright unintentionally. When such accidental infringement occurs, copyright law holds the user strictly liable. Prior literature has questioned whether the strict liability standard is normatively defensible. In particular, prior literature has asked whether the strict liability standard ought to be reformed for economic reasons. This Article examines the accidental infringement problem from a new perspective. It considers whether it (...) is fair to hold copyright users strictly liable for accidental infringements of copyright. This Article argues that the strict liability standard is not fair because it results in copyright users being held liable for accidents for which they are not morally responsible. Using the moral philosophy literature on responsibility, this Article explores our intuitions surrounding copyright’s liability standard in order to better understand why strict liability in this context seems “harsh” and “inequitable.” In turn, this provides an argument for reforming copyright’s liability rule and adopting a negligence standard. This Article then argues that, within the United States, the proposed reform to copyright’s liability rule should be accomplished by modifications to the existing fair use doctrine. (shrink)

This paper explores the philosophical aspects of the "Great Introduction" of Abū Ma'šar, one of the great figures of Arabic astrology and an associate of al-Kindī, the great 9th century philosopher. I argue that the following points of philosophical interest may be found in this text: 1. Astrology is described as a "master science" along the lines proposed by Aristotle, i.e. it provides principles for lower sciences. Also he supplies arguments to ground astrology on methodological grounds, such as the use (...) of empirical evidence and testimony. 2. Abū Ma'šar broadly follows al-Kindī's explanation of how the stars influence the sublunary world, by heating the elements. This agrees with al-Kindī's work "On the Proximate Agent Cause of Generation and Corruption," and I identify some parallels between the two works. 3. Finally, Abū Ma'šarr considers whether human freedom is compatible with this causal account. He holds that human actions do fall under the class of the "possible" and not the "necessary," but only because for him the "possible" is what happens sometimes, not always. Thus he seems tacitly to hold that genuine choice is compatible with causal necessitation. (shrink)

Antisthenes (c. 445- c. 365 BC), was a prominent follower of Socrates and bitter rival of Plato. In this revisionary account of his philosophy in all its aspects, P. A. Meijer claims that Plato and Aristotle have corrupted our perspective on this witty and ingenious thinker. The first part of the book reexamines afresh Antisthenes' ideas about definition and predication and concludes from these that Antisthenes never held the (in)famous theory that contradiction is impossible. The second part of the book (...) argues that Antisthenes' logical theories bear directly on his activities as an exegete of Homer and hence as a theological thinker. In the Chinese text of the *Vimuttimagga, namely the Ji?tu? dào lùn, the word ji? is used as a technical abhidhamma term. It is used to refer to an initial cognitive activity through the five material sense organs. In the published English translation, the term is not understood clearly. There are similarities and differences between the two terms, ji? and visayappavatti. They are linked to similar doctrinal structures and technical terminology, especially the concept of bhava?ga, which is a distinctive doctrine (...) of Sri Lankan Therav?da. On the other hand, visayappavatti implies an initial cognitive activity by any of the six sense organs, while the term ji? refers to an initial cognitive activity only through the five material sense organs. A comparative study of the two terms proposes the following implications. Firstly, the text *Vimuttimagga is related to Sri Lankan P?li abhidhamma because the orientation of the two terms is more than similar. Secondly, the text represents an early phase of the extant P?li abhidhamma because the term ji? is less mature terminology than the term visayappavatti. (shrink)

U ovom bih radu predložio jedan filozofijski pristup slici koji razlaže formu slike polazeći od njezinih formalnih elemenata, likovnih počela: kao točka ili linija, i načela: kao primjerice zrcaljenje, rotacija ili bilo koji drugi aspekt simetrije. Zanima me ponajviše sama likovnost, odnosno navlastitost umjetničkog djela u slikarstvu Nikole Božidarevića. Pri tom tumačenju pomoćno ću se poslužiti neopitagorejskom logikom kao metodom ili oruđem, na tragu metodičkog sustava I. Damjanov, čime ću, smatram, najelastičnije doći do razumijevanja cjeline načinom bliskim Paul Kleeovom promišljanju (...) slike. Potom bih dao na takovoj formalnoj analizi, koju zapravo na koncu čitam jednim filozofijskim prilogom umjetnosti, potvrdu o stilskom utjecaju braće Crivelli i Vittorea Carpaccia na formiranje stila Božidarevićeva slikarstva. Usput ću pokazati kako se takova formalna analiza obrće u jednom živom preokretu u samoodgajanje promatrača prema najvišim oblicima ljepote, tj. poredku, razmjeru, određenosti, koje najviše pokazuju matematičke znanosti.I wish to propose a philosophical approach toward the painting that explains the form proceeding from it’s formal elements, such as a dot and a line on the one hand, or as reflection, rotation or any other aspect of symmetry on the other hand. I am mostly interested in the visual aspects of painting. To support my interpretation I will use Neo pythagorean logic to reach understanding similar to P. Klee’s reflection upon the painting as such. Thereupon, by such a formal analysis, that ultimately is perceived as a philosophical contribute to arts, we will provide verification of brothers Crivelli’s and Vittorio Carpaccio’s stylistic influence on forming of Božidarević’s style. At the same time we will reveal how this formal analysis transforms itself, in a vivid reversal, into a self-education of the observer towards the highest forms of beauty, such as order, proportion, definiteness, mostly revealed by the mathematical sciences.
